McGraw, Chesney File Court Papers in Buffalo Arrest Case

An attorney for Tim McGraw and Kenny Chesney said the singers have no definite plans to sue New York's Erie County Sheriff's Department. The pair filed court papers Tuesday (Aug. 29) that cleared the way for such action. "It doesn't mean we're going to sue anybody, but you have to do this [file papers] within 90 days of the event to preserve your right to sue," attorney Thomas Eoannou told country.com. "That's all we did. No decision has been made to sue anybody." The court document claims the singers, along with McGraw's production manager, Mark Russo, suffered physical and psychological injuries during their arrest June 3 at a concert venue outside Buffalo. Chesney was riding a deputy's horse backstage at the George Strait Country Music Festival when authorities ordered him to dismount. McGraw and Russo stepped in and allegedly scuffled with police as they tried to physically remove Chesney from the horse. McGraw originally was charged with felony assault. The offense later was reduced to a misdemeanor. Chesney and Russo also face misdemeanor charges. Erie County Sheriff Patrick Gallivan called the damage claims "ridiculous," The Buffalo News reported. Eoannou said he included the injury claims because the law requires mention of "any possible area of the law that you might sue under." Erie County District Attorney Frank J. Clark said there would be a trial for McGraw and Chesney, lawsuit or not. "There will be no plea deals, no charges dropped," Clark said, according to The Buffalo News. "This case will go to trial and the courts will decide." McGraw, Chesney and Russo are set for trial Dec. 7.
